The undersigned acknowledges and agrees that this application is submitted without any obligation on the part of OEB Breakfast Co. Inc. Company or its affiliates, and that any misrepresentation, whether intentional or unintentional, in the information submitted by the undersigned in this application form or otherwise in connection with this application shall be grounds for immediate termination of any franchise agreement that may be entered into between OEB Breakfast Co. Inc. Company and the undersigned.
The undersigned further acknowledges and agrees that the receipt, investigation and processing of this application by OEB Breakfast Co. Inc. Company shall entail no commitment or liability whatsoever on the part of OEB Breakfast Co. Inc. Company, its affiliates, its employees, shareholders, directors, officers or agents.
The undersigned further acknowledges and agrees that OEB Breakfast Co. Inc. Company will have the right, exercisable in its sole and unfettered discretion, to approve or reject the undersigned's franchise application, and that OEB Breakfast Co. Inc. Company will not enter into any discussion or correspondence regarding its decision to reject any applicant.
The undersigned consents to the collection, use and disclosure by OEB Breakfast Co. Inc. Company, its affiliates and third party service providers of the information provided herein for the following purposes:
- Assessing and processing this franchise application;
- Assessing the credit history and credit worthiness of the applicant;
- Conducting a detailed investigation of the background and history of the applicant;
- Assessing the undersigned's suitability, both financial and otherwise, to be a franchisee of OEB Breakfast Co. Inc. Company;
- Assessing the undersigned's ability to satisfy the obligations (financial and otherwise) that it would be subject to as a franchisee of OEB Breakfast Co. Inc. Company; and
- If the undersigned's application as a franchisee is accepted, for the purpose of allowing OEB Breakfast Co. Inc. Company to administer the relationship between the franchisee, OEB Breakfast Co. Inc. Company and its affiliates and for the purpose of allowing OEB Breakfast Co. Inc. Company and its affiliates to administer the Canadian franchisee system.
The undersigned acknowledges that OEB Breakfast Co. Inc. Company, its affiliates and third party service providers may from time to time collect additional information concerning the undersigned from third party sources, and the undersigned consents to the collection, use and disclosure by OEB Breakfast Co. Inc. Company, its affiliates and third party service providers of such information for the purposes noted above.
The undersigned acknowledges and agrees that OEB Breakfast Co. Inc. Company and its affiliates may disclose any or all of the information provided herein by the undersigned (or collected from third party sources) to its third party service providers or as may be required by law.
The undersigned acknowledges and agrees that OEB Breakfast Co. Inc. Company, its affiliates and its third party service providers will retain the information provided herein by the undersigned (or collected from third party sources) for such length of time as OEB Breakfast Co. Inc. Company, its affiliates or its third party service providers may require (or as may be required by law).
The undersigned acknowledges that it has been informed by OEB Breakfast Co. Inc. Company that the employees and agents of OEB Breakfast Co. Inc. Company, its affiliates and third party service providers, as well as all other persons to whom this information has been disclosed pursuant to applicable law, will have access to the information provided herein by the undersigned, and that this information will be stored at the head office of OEB Breakfast Co. Inc. Company and/or its affiliates (and, as applicable, with those third party service providers or other persons to whom this information may be disclosed from time to time by OEB Breakfast Co. Inc. Company and/or its affiliates).I declare that all the information in this application is correct and I authorize OEB Breakfast Co. Inc. Company to conduct its own enquiries as to the accuracy of these statements.
